Clery Liaison

Overview

Pursuant to the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act), MSU is required to disclose statistics for certain crimes in an annual security report. This report includes statistics for crimes that were reported to have occurred on campus, on or in certain non-campus properties, and on public property, which were reported to “Campus Security Authorities” or local law enforcement agencies. In order to ensure our continued compliance, we are asking that a Clery Liaison be identified in each unit.

Unit Obligations

Each unit will identify a person—a Clery Liaison—who will help coordinate the gathering of pertinent information relating to MSU’s Clery Act obligations and work with our Clery Act Compliance Coordinator. The Clery Liaison will be considered our main Clery contact for your unit and help with the below Clery Liaison obligations.

Each Org Code/Org Name will serve as a unit. Multiple units can combine and share a Clery Liaison where reasonable based on the function of their org. To create a combined unit for purposes of identifying a Clery Liaison, please communicate with the Clery Act Compliance Coordinator.

Clery Liaison Obligations

The Clery Liaison serves as a unit’s main Clery contact and will be contacted to help with the following:

  1. Identify and register Campus Security Authorities (CSAs) for unit.
  2. Identify and register non-campus properties unit uses.
  3. Identify and register locations for university-sponsored overnight student travel.
  4. Serve as contact for additional compliance questions that arise.

Clery Liaisons will be asked to review their department’s CSA list twice per year. Additionally, throughout the year, Clery Liaisons can and should register CSAs, properties, and travel at any time they are made aware of new information.

  • 1 – Identify and Register CSAs

    Who is a CSA?

    The Clery Act designates the following individuals as Campus Security Authorities (CSA):

    • Members of an institution’s campus police or campus security department.
    • Any individuals who are responsible for campus security but who do not constitute a campus police department or a campus security department.
      • Examples: security guards, student ID checkers at recreation facilities
    • Any individual or organization specified in an institution’s statement of campus security policy as an individual to which students and employees should report criminal offenses.
      • Examples: police department, Office of Institutional Equity
    • An official of an institution who has significant responsibility for student and campus activities, including but not limited to, student housing, student discipline and campus judicial proceedings.
      • An official is defined as any person who has the authority and duty to take action or respond to a particular issue on behalf of the institution.
      • Examples: Deans, student housing staff, Athletics staff, student activities coordinators, student judicial officers, faculty/staff advisors to RSOs, faculty/staff who lead overnight university-sponsored student travel

     

    Who is not a CSA?

    Anyone who does not fall into the above categories is not a CSA. Examples include administrative and clerical staff who are not responsible for student/campus activities, staff who supervise student employees but do not fall under the above categories, individual faculty who do not have significant responsibility for student activity outside the classroom.

    Clery Liaison CSA Registration Responsibilities

    There is a difference between a Clery Liaison and a Campus Security Authority. A Clery Liaison is a role designed to collect and report required information for their units and assist the University with compliance. A CSA is a person who meets one of the definitions under the Clery Act, and MSU must disclose crimes that are reported to CSAs.

    Twice a year, Clery Liaisons will receive a list of active CSAs in their department to review for any adjustments.     What do we do with this information?

    The Clery Act Compliance Coordinator will review completed forms. If the individual is determined to meet the criteria of a Campus Security Authority, they will be notified of this responsibility via email. Additionally, the CSA will receive an email prompting them to complete CSA training via an online module within 30 days of the notice.

  • 2 – Identify and Register Non-Campus Properties

    What is Non-campus Property?

    Non-campus property is defined as:

    1. Any building or property owned or controlled by a student organization that is officially recognized by the institution; or
    2. Any building or property owned or controlled by an institution that is:
      1. used in direct support of, or in relation to, the institution's educational purposes;
      2. is frequently used by students; and
      3. is not within the same reasonably contiguous geographic area of the institution.

    Control of a space means that the university directly or through third party rents, leases, or has some form of written agreement for use of the building/property, or a portion of it.

    What do we do with this information?

    In order to comply with our obligations under the Clery Act, MSU must request crime statistics from local law enforcement agencies for crimes reported to have occurred in MSU’s Clery Geography during the dates in which MSU owned or controlled the property. The applicable statistics are compiled and included in our Annual Security and Fire Safety Report. 

  • 3 – Identify and Register Locations for University-sponsored Overnight Student Travel

    What travel is reportable?

    Travel that must be reported includes:

    1. University-sponsored – where the university (or 3rd party vendor on behalf of university) arranges the travel; and
    2. The University has a written agreement for the use of the space.
      1. This would give university ‘control’ over the physical space.
      2. Example: hotel reservation

    This obligation applies to both domestic and international locations and pertains to any level student (but does not include solely faculty/staff travel).

    What is not reportable travel?

    Travel that is independently arranged by the student. Additionally, day trips with no space use agreement are not reportable.
